These Terms and Conditions apply to every quotation, order, collection, and delivery unless Blurock Quarries (Pty) Ltd agrees otherwise in writing.
Orders are subject to written acceptance, product availability, and the customer’s approved credit status.
Prices exclude VAT unless expressly stated otherwise and may be adjusted if input costs, fuel, statutory charges, taxes, or agreed escalation factors change.
Prices are increased annually on the 1st of January.
Payment is due on the terms stated in the quotation or approved credit agreement.
Overdue amounts may attract interest at the maximum rate permitted by law, and Blurock Quarries may suspend further supply until all overdue amounts are paid.
Ownership of products remains with Blurock Quarries until payment has been received in full, while risk passes to the customer on collection or delivery, as applicable.
Delivery dates and times are estimates and may be affected by production, traffic, weather, site conditions, or other circumstances beyond reasonable control.
The customer must provide safe, suitable, and lawful access for delivery vehicles and is responsible for delays, standing time, demurrage, failed deliveries, and additional handling caused by unsuitable access or site conditions.
Quantities recorded by Blurock Quarries’ calibrated weighbridge will be accepted as the quantity supplied in tons.
The customer must inspect products and delivery documents promptly and notify Blurock Quarries in writing of any shortage, incorrect product or apparent defect within the period stated on the quotation or delivery note.
Products must be selected and used for their intended purpose, and the customer remains responsible for confirming that the specified product is suitable for its design and application.
Blurock Quarries will not be liable for delay or failure caused by circumstances beyond its reasonable control.
Any limitation of liability, indemnity or assumption-of-risk provision applies only to the extent permitted by the Consumer Protection Act 68 of 2008 and other applicable South African law.
The laws of the Republic of South Africa govern these Terms and Conditions.
Any variation must be recorded in writing and approved by an authorised representative of Blurock Quarries. If any provision is unenforceable, the remaining provisions will continue to apply.
